Terms of Service

These Terms govern your use of Berojgari ("the Service"), operated by Sarjan Budha ("we", "us", "our"). By creating an account or otherwise using the Service, you agree to these Terms.

1. Who can use Berojgari

You must be at least the minimum digital-consent age in your jurisdiction to use the Service. If you are under 18, you must have permission from a parent or guardian.

You may not use the Service if you have previously been permanently banned, unless we have expressly reinstated your access.

2. Your account

We assign your public username (for example, berojgar_1837). You cannot choose or change it in the MVP.
You are responsible for keeping your login credentials secure.
You are responsible for all activity that occurs under your account.
You may not sell, transfer, or share your account.
You may not create multiple accounts to evade restrictions, manipulate Pushes or reports, or engage in coordinated inauthentic behavior.

3. Content you post

You retain ownership of the content you post ("Your Content"). By posting on Berojgari, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute Your Content solely to operate and improve the Service, and to permit other users to view and interact with it as intended by the Service.

This license ends when you delete Your Content, except:

Backups may retain a copy for up to 30 additional days
Copies shared by other users (e.g., quoted in another user's post) may remain
We may retain records of Your Content where required by law or to complete an ongoing investigation of abuse

4. Rules of use

By using the Service, you agree to follow our [Community Guidelines](./COMMUNITY_GUIDELINES.md). Additionally, you agree not to:

Use the Service to harass, threaten, intimidate, or harm any person
Post content that is illegal, hateful, sexual involving minors, or that infringes another person's rights
Attempt to identify, deanonymize, or expose the real identity of any user
Attempt to gain unauthorized access to the Service, other accounts, or our infrastructure
Interfere with, disrupt, or overload the Service (including via automated scraping, bots, or denial-of-service techniques) beyond what is permitted by our robots.txt and rate limits
Circumvent security features, rate limits, or moderation measures
Reverse engineer, decompile, or disassemble the Service except to the extent required by applicable law
Use the Service to send unsolicited advertising, spam, or promotional material
Impersonate another person or entity
Use the Service to conduct or promote illegal activity

Violations can result in warnings, content removal, temporary restrictions, suspension, or permanent ban.

5. Moderation and enforcement

We may, at our discretion:

Remove or hide content that violates these Terms or the Community Guidelines
Restrict, suspend, or terminate accounts
Report unlawful activity to appropriate authorities
Cooperate with law enforcement subject to valid legal process

We aim to apply enforcement consistently and offer an appeal process (see Community Guidelines), but we do not guarantee that all rule-violating content will be caught or removed.

6. Reports and safety

If you see content that may violate these Terms, use the Report feature in the Service. Reports are confidential. Misuse of the report system (submitting false or malicious reports) may lead to restrictions on your account.

7. Privacy

Your use of the Service is also governed by our [Privacy Policy](./PRIVACY_POLICY.md), which explains what data we collect and how we use it. Do not use the Service if you do not agree with our Privacy Policy.

8. Anonymity

Berojgari is designed to keep your identity private from other users. However:

If you post information that identifies you, we cannot restore your anonymity.
We maintain internal records (such as email, phone, IP) for security, moderation, and legal compliance.
We may disclose these records where required by valid legal process. See Privacy Policy for detail.

9. Third-party content and links

Content posted by other users represents their views, not ours. Links posted by users lead to third-party sites we do not control. Use judgment before clicking, sharing personal information, or acting on advice from other users.

10. Not professional advice

Content on Berojgari (including experiences shared by users about immigration, education, employment, finance, law, or medicine) is personal experience only. It is not professional advice. Do not rely on it as a substitute for consulting a qualified professional.

11. Intellectual property

All rights in the Service (including the Berojgari name, logo, software, and design) belong to us or our licensors. You may not copy, modify, distribute, or create derivative works of the Service without our permission, except as allowed by these Terms or applicable law.

12. Feedback

If you send us suggestions or feedback, we may use them freely without obligation to you.

13. Termination

You may delete your account at any time from Settings.

We may suspend or terminate your access at any time for any violation of these Terms, the Community Guidelines, or applicable law, or where we reasonably believe termination is necessary to protect the Service or its users.

On termination:

Your public content is hidden from the Service
Personal information is purged per the Privacy Policy retention schedule
Sections of these Terms that by their nature should survive termination (including IP, disclaimers, limitations, and dispute resolution) survive

14. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:

The Service will be uninterrupted, error-free, or secure
Any specific content will be available or accurate
Defects will be corrected

To the maximum extent permitted by law, we disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

15. Limitation of liability

To the maximum extent permitted by law:

We are not liable for indirect, incidental, special, consequential, or punitive damages
Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us in the twelve months preceding the claim (typically zero, since the Service is free) or (b) USD $100

Some jurisdictions do not allow certain limitations; in those jurisdictions our liability is limited to the maximum extent permitted by law.

16. Indemnification

You agree to indemnify and hold us harmless from claims arising out of Your Content, your use of the Service in violation of these Terms, or your violation of any law or another person's rights.

17. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced in-app and by email at least 30 days before taking effect. Continued use after the effective date constitutes acceptance.

18. Governing law and disputes

These Terms are governed by the laws of Nepal.

Any dispute arising out of these Terms or the Service will be resolved in the courts of that jurisdiction, except that either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights.

If any provision of these Terms is held unenforceable, the remainder remain in effect.

19. Entire agreement

These Terms, together with the Community Guidelines and Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.
